Some Florida closing costs aren't negotiable or estimated: they're set by state law. Documentary stamp taxes, the intangible tax on a new mortgage, and title insurance premiums all follow fixed formulas. This calculator works those out exactly, adds anything you type in (like commission or a mortgage payoff), and lists what's left for your closing agent to itemize.

The rates, and who pays them

  • Documentary stamp tax on the deed: 70 cents per $100 of the price or any part of $100 (Florida Statutes 201.02). Paid by the seller under the standard Florida Realtors/Florida Bar contract.
  • Documentary stamp tax on a new mortgage: 35 cents per $100 of the loan or any part of $100 (F.S. 201.08). Paid by the buyer.
  • Intangible tax on a new mortgage: 2 mills, which is 0.2% of the loan (F.S. 199.133). Paid by the buyer.
  • Owner's title insurance: the premium is set by the State of Florida (Florida Administrative Code 69O-186.003): $5.75 per $1,000 up to $100,000, $5.00 per $1,000 from $100,000 to $1 million, $2.50 per $1,000 from $1 million to $5 million, $2.25 per $1,000 from $5 million to $10 million and $2.00 per $1,000 above that, with a $100 minimum. Who pays depends on which option is checked in paragraph 9(c) of your contract.
  • Lender's title policy: when it's issued at the same time as the owner's policy, the state rate is a minimum of $25 for coverage up to the owner's policy amount. Paid by the buyer.
  • Recording fees: $10.00 for the first page and $8.50 for each additional page (F.S. 28.24). The buyer pays to record the deed and mortgage; the page count comes from your closing agent, so recording isn't included above.
